Apply for a ROW or Civil Construction Permit

Right of Way Permits:

Permits are required for any work in the public right-of-way of City streets. Work in the right-of-way of Hwy 213 & 211 requires a permit from ODOT (Oregon Department of Transportation).

Work in the right-of-way of City roads requires a permit from the City of Molalla. Contact the City if you are not sure whether a street or road is under ODOT or City jurisdiction.

The public right-of-way includes the area behind the curb, typically extending at least one foot behind the sidewalk on improved streets. Identifying the right-of-way is more challenging on unimproved streets, which lack curbs and/or sidewalks. If a property marker is not easily visible, a licensed surveyor should be consulted to confirm the location of the right-of-way or property line on these unimproved streets.

A permit is required for a small project, such as a service connection. sidewalk and/or driveway approach and franchise utility work within the City public right-of-way or public easement, and shall be obtained through City’s Public Works Department by emailing us at communitydevelopement@cityofmolalla.com or by calling 503-759-0324.

Civil Construction Permit:

The Public Works Construction Permit Application is for larger residential, commercial, and industrial development projects that include the construction of public infrastructure.

A copy of the Public Works Department design requirements, which is available for download from the City website, (Molalla Standard Specification for Public Works Construction) will be used as a guide during the review of all proposed new, or improvements to, public works facilities.

The City of Molalla will hold a pre-application conference with the Applicant (owner/developer), unless otherwise waived by the Public Works Director, before formal application for public works permits and review of site design and construction plans. The pre-application process allows the applicant and the City to discuss the proposed project and the standards and regulations that will apply while the project is still in a preliminary stage. Any specific development standards, regulations, or problem areas can be discussed before the applicant makes a substantial investment in the project or proceeds with a formal application, unaware of the issues.


Plan Check and Permit

Plan Check: Design reviews are required, and review approvals issued on all construction projects within public right-of-way, easements, or property which will eventually be maintained and operated by the City of Molalla. Projects that require plan checks include all private storm drainage, sanitary sewer, and water systems that will be connected to or that will discharge into a system under the jurisdictional control of the City of Molalla.

Public Works Permit: No work shall be performed, nor materials stored, nor encroachment made on or within a Right-of-Way, Public Easement, or Public Utility Easement without first acquiring a permit from the City’s Public Works Department, except as provided by City Ordinance. Projects requiring Public Works Permits shall include, but not necessarily be limited to, improvements or upgrades to publicly owned and maintained streets, sidewalks, curbs, driveway approaches, water systems, sanitary sewer systems, and storm drainage systems.

Any permits required by federal, state, and local governments shall be obtained by the person proposing the improvements.
